This research project identifies the concept of compliance and characterizes current risk control practices in Quebec engineering and construction companies. Operational risk representing the probability of loss caused by a failure (of systems, of procedures or people) requires special attention to ensure the sustainability of an organization. Compliance that essentially encompasses behavioral control and/or incentive processes to enforce values, laws and regulations beyond the technical obligations of observing quotes from clients or owners is a solution to mitigate this risk.
A questionnaire was developed to conduct 12 interviews with consulting and construction firms of various sizes (large, medium and small) in Québec (general management, legal department or compliance department). The analysis of the 12 organizations identified the challenges of compliance. It must evolve at the same pace as the organizations. The system must be adapted to the business model.
This work demonstrates the effect of the size of the organizations and the usefulness of setting up mechanisms and/or programs to ensure the quality and integrity of services.
